Terms of Service

Please read these Terms of Service ("Terms") carefully before using the CloudTruck platform, mobile application, and related services (collectively, the "Services") operated by CloudTruck Logistics Pvt. Ltd. ("CloudTruck", "we", "our", or "us"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or the business you represent. By using the Services, you represent and warrant that you meet these requirements.

The Services are intended for commercial and business use in connection with the transportation and logistics of goods within India. Use for personal, household, or non-commercial purposes is not permitted unless expressly stated.

2. Account Registration

You must create an account to access the Services. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at legal@cloudtruck.in if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in prohibited conduct.

3. Services and Bookings

CloudTruck provides a platform for customers to request freight and logistics services from registered fleet operators and drivers. We act as an intermediary and are not ourselves a carrier or transporter.

When you submit a booking request, it constitutes an offer to engage logistics services under the terms displayed at the time of booking. A booking is confirmed only upon acceptance by CloudTruck and the assigned operator.

Delivery timelines, vehicle availability, and routes are subject to operational conditions including traffic, weather, regulatory requirements, and force majeure events. We do not guarantee specific delivery windows unless stated explicitly in writing.

4. Payments and Billing

All charges are displayed in Indian Rupees (INR) inclusive of applicable taxes unless stated otherwise. Payment is due at the time of booking or as specified in your invoice.

We use third-party payment gateways to process transactions. By making a payment, you agree to the terms of the applicable payment processor. CloudTruck does not store your full card or bank account details.

Refunds, if applicable, are processed in accordance with our Cancellation and Refund Policy. Disputed charges must be raised within 7 days of the invoice date by contacting our support team.

5. Customer Obligations

As a customer, you agree to:

  • Provide accurate pickup and delivery information, including correct addresses, contact persons, and goods descriptions.
  • Ensure that goods tendered for transportation are properly packed, labelled, and compliant with all applicable laws and regulations.
  • Not tender prohibited goods including, but not limited to, hazardous materials, contraband, perishables requiring special handling, or items banned under Indian law.
  • Ensure that e-way bills and other statutory documents are valid and accompany the shipment where required under the Goods and Services Tax (GST) regime.
  • Cooperate with drivers and logistics partners during pickup, transit, and delivery.

6. Liability and Limitation

CloudTruck's liability for loss or damage to goods in transit is limited to the extent expressly agreed in the booking confirmation or as mandated by applicable law. We are not liable for indirect, consequential, incidental, or punitive damages, including loss of profit or business opportunity.

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, government actions, road closures, or network outages.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the Services shall not exceed the amount paid by you for the specific booking giving rise to the claim.

7. Intellectual Property

All content, trademarks, logos, software, and materials available on the Services are owned by or licensed to CloudTruck. You may not copy, modify, distribute, or create derivative works without our prior written consent.

You retain ownership of any content you upload to the Services (such as documents and images). By uploading content, you grant us a non-exclusive, royalty-free licence to use, store, and process that content solely for the purpose of providing the Services.

8. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws.
  • Attempt to gain unauthorized access to our systems or another user's account.
  • Reverse-engineer, decompile, or tamper with any part of the platform.
  • Submit false bookings, fraudulent payment information, or misleading documents.
  • Harass, threaten, or harm drivers, operators, or CloudTruck personnel.
  • Interfere with the integrity or performance of the Services.

Violation of these prohibitions may result in immediate account suspension and may be reported to relevant law enforcement authorities.

9. Termination

You may close your account at any time by contacting our support team. We reserve the right to suspend or terminate your access to the Services at our discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to CloudTruck, our partners, or other users.

Upon termination, your right to use the Services ceases immediately. Provisions relating to liability, intellectual property, and dispute resolution survive termination.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.

11. Changes to These Terms

We may revise these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. For material changes, we will provide advance notice via email or in-app notification. Continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
